Chantix Lawsuit Settlement: What’s The Likelihood?

The question of the likelihood of a Chantix lawsuit settlement has grown in the wake of additional recent negative press over Chantix side effects and FDA compliance issues by drug manufacturer Pfizer.

Although Pfizer has not yet made any public settlements over Chantix, its problematic smoking cessation aid, experts believe the pharmaceutical giant may be in an even less defensible position as more side effects and improperly recorded Chantix adverse event reports come to light.

More than 1200 Chantix lawsuits

So far, more than 1,200 plaintiffs have joined litigation against the drugmaker for inadequate testing and warning of a wide array of Chantix side effects. Such side effects include mood swings, aggressive behavior, violence, blackouts, Stevens-Johnson syndrome, Chantix diabetes, depression and suicide.

Just this last month a pair of parents filed a wrongful death suit against Pfizer after a Pittsburgh area man killed his wife and committed suicide, leaving their four minor children without parents. The man reportedly began taking Chantix just a week or two before the incident.

Reports that Chantix suicides were misreported by Pfizer

More recently, it was reported that Pfizer failed to properly submit thousands of Chantix side effects adverse event reports to the FDA, thus depriving the agency of data necessary in the effective regulation of the drug. According to a study conducted by the Institute for Safe Medication Practices (ISMP), Pfizer only last year submitted dozens of reports of Chantix suicides that had occurred in years prior.

No Chantix class action lawsuit – Chantix Multidistrict Litigation instead

Despite overwhelming reports of Chantix side effects, there have not yet been any Chantix class action lawsuits approved in the US judicial system. Instead, widespread lawsuits have been consolidated in multidistrict litigation (MDL), a legal process similar to class action that retains the individuality of each lawsuit involved. That MDL is centralized in the Northern District of Alabama for pretrial proceedings and oversight.

First Chantix lawsuit trial might come in early 2012

According to attorneys involved in the litigation, the first Chantix lawsuit could go to trial in early 2012. A Chantix lawsuit settlement could occur before any lawsuit goes to trial, during trial or after trial. If Chantix is ever recalled, there may be an even greater chance that Pfizer will seek to reach a Chantix lawsuit settlement with plaintiffs.
